Chinese court orders Apple to cough ?100k to writers for violating copyright

Apple got a nasty post-Christmas present in China on Thursday when a Beijing court hit it with a 1.03m yuan (?102,000) fine after ruling the fruity tech titan was responsible for applications which appeared on its App Store containing unlicensed content.

The Beijing No 2 Intermediate People's Court concluded that Apple had violated China?s Copyright Law and ordered it to cough up to the plaintiffs ? eight Chinese writers who formed the China Written Works Copyright Society (CWWCS) in a bid to get compensation.

The decision, while a victory for the eight and two separate companies, was far lower than the 23 million yuan (?2.3m) claim they filed back in February, according to Apple Insider.

They had apparently claimed that Apple knew about the illegal content for some time but dragged its heels over removing the apps and told them to contact the pirate app developers themselves.

This isn?t the first time Apple has been targeted by Chinese authors seeking compensation for apps containing unlicensed copies of their works.

Back in March it emerged that the Writers? Rights Alliance of 22 authors filed a 50 million yuan (?5m) lawsuit relating to 95 books allegedly sold illegally on the App Store.

Then in November a Taiwanese writer and film director revealed how he had been branded an ?idiot? by Apple staff in Hong Kong after flying to the region to confront them over a long-running copyright saga.

Once again, the issue revolved around the author trying and failing to get Cupertino to remove copyright-infringing apps containing his content.

A spokeswoman for Apple told the BBC that the company takes "copyright infringement complaints very seriously".

"We're always updating our service to better assist content owners in protecting their rights," she added. ?

Hints for Playing This Course:

Most of the fairways are pretty straight and are wide enough to make it easy to play. There have been some complaints about debris and plants growing in the fairways that make it difficult to complete certain shots, but these complaints are not widespread.

The most difficult hole is #11 with a dog leg to the right. You'll need to keep your wits about you on this hole, particularly with the water hazard. Your best bet is to line up your shot with the edge of the lake and use your irons from this point on.

The first tee is also a bit of challenge, since you'll be teeing off over the lake. Remember, water always affects the ball's direction, so make sure to correct your shot beforehand. The sixth tee is probably the easiest hole on the course and should be easily completed in three shots. Most professionals should even be able to birdie this hole if their approach is right.

Watch out for the water hazards on the 8th and 15th tees as they run alongside the fairway and make it difficult to line up your shot to the green. Once again, it's best to play it safe and use your irons instead of relying on early distance from your woods.

The 18th tee is a killer, but at least you'll end up at the clubhouse door and can relax your round away.

Mandela close to medical care at home

JOHANNESBURG (AP) ? The doctors treating former South African leader Nelson Mandela believe he should remain in Johannesburg for now to be close to medical facilities that can provide care to the 94-year-old, the government said Thursday.

Mandela left a hospital Wednesday evening after nearly three weeks of treatment there, and was brought to his home in the Johannesburg neighborhood of Houghton. The anti-apartheid icon, also known by his clan name, Madiba, has spent more time in recent years in the rural village of Qunu in Eastern Cape province, where he grew up.

Mandela's grandson, Mandla Mandela, said he hopes "it won't be too long before he's with us back in Qunu, where he belongs," but acknowledged that the doctors' assessment is critical to any decision to travel.

"It can be a strenuous trip," the grandson said in an interview with eNCA, a South African television news channel. "We will await the feedback from the doctors as to when he will be fit and ready to come back home."

Mandela was admitted Dec. 8 to a hospital in the South African capital of Pretoria, 50 kilometers (30 miles) north of Johannesburg. The ex-president was treated for a lung infection and also had a procedure to remove gallstones.

"Where Madiba goes, in which period, in which times, is a matter that is entirely dependent on his own wishes. Whatever he wishes, we will do," presidential spokesman Mac Maharaj told eNCA.

"But right now, the doctors have considered it necessary and good that he should be in Houghton so that he's close to all the facilities where we can give him high care," Maharaj said.

Maharaj noted that Mandela had been in good spirits while receiving President Jacob Zuma and other visitors while he was hospitalized.

"Madiba was doing well, but as you know, when you're recovering there are ups and downs, slight ups and downs, and the doctors are looking for a steady progress and that began to be registered over the last few days," the spokesman said.

Mandela is revered around the world as a symbol of sacrifice and reconciliation, his legacy forged in the fight against apartheid, the system of white minority rule that imprisoned him for 27 years. The Nobel laureate served one five-year term as president after South Africa's first democratic elections in 1994.

Maharaj said Mandela is able to see his family "more easily" now that he is at home, but he appealed to the public to respect the former president's privacy "to allow the best possible conditions for his full recovery."

Photography exhibits at the Asia Society challenge self-perception ...

Tell us about yourself!

That's the invitation for those who make it into the current exhibition at the Asia Society Texas Center, and hundreds of visitors have taken the offer to heart. You can view their self-impressions along with their photos at the Grand Hall of the Texas?Center's new home in the Museum District. Even more responses can be found on the Center's website?and social media platforms.?

The actual question is "What Are You?" and, since it's tied to a photo exhibition by the gifted photographer and filmmaker Kip Fulbeck and built on the concept of the book by the same name,?part?asian, 100% hapa (HOP-ah, a Hawaiian word meaning of mixed racial heritage with partial roots in?Asian or Pacific Islander ancestry), one might think it's drawing those Americans who are part Asian. But it welcomes and has attracted all "kinds" of Houstonians who might answer the question with "German-English," "Bankruptcy Attorney" or "Mother," or something entirely different, sentimental or funny.

?"It has been a great interactive project and very educational in teaching about diversity."?

"It has been a great interactive project and very educational in teaching about diversity," says Jordan Dupuis, development coordinator at the Center. He took the show for a preview outing in October at an interactive booth at the Texas Contemporary Art Fair ? and it was a hit. "People were very engaged by the project. It draws people in and gets them thinking about how they define themselves."

You can't tell how people will respond based on age or looks, Dupuis says ? sometimes you get very thoughtful responses and sometimes more whimsical ones. "Some were very intense and very interesting in their answers; some were comical."

A few of our favorites among the current shots at the Center include the rather proper-looking lady who writes, no surprise: "British." The happy-looking man who writes: "I am making cancer history!" with a line drawn through "cancer." The young woman who wrote: "I'm 25% Chinese, 75% Viet. 100% Sunshine!" And the dapper gentleman who wrote: "I am 100% Chinese born living the American dream to the fullest with the most beautiful Mexican American woman by my side."

"The interactive component of the exhibition provides a forum for the exploration of Houston's cultural landscape, and truly reinforces the diversity and multiculturalism that have made Houston a microcosm of the entire country," says Patsy Brown, the Center's communication director. "Perhaps someone's statement will spark something of commonality elsewhere."?

Kip Fulbeck?will be at the Center on Jan. 12 at 3 p.m. for an artist talk?and to take photographs of Houstonians himself. For a glimpse of what you can expect to experience, you can view him?on YouTube delivering a commentary both witty and serious on race and identity.

Additional programs complementing the exhibition will also be presented at the Asia Society Texas Center in 2013. To name a few: The screening of experimental shorts from the Dallas Film Festival Experimental on Jan. 25; a Family Day with storytelling and portraiture activities on Feb. 24; and a talk with Yul Kwon, PBS host and winner of Survivor: Cook Islands, on April 4. ?

The Fulbeck portrait exhibition is free, as is visitor participation.?Those who wish to see a second exhibition also tied to the concept should see the groundbreaking exhibition Portraiture Now: Asian American Portraits of Encounter, which originated as the first Asian in America exhibition by the Smithsonian's National Portrait Gallery. It includes the work of seven artists and an invigorating collection of paintings, drawings, videos and more that give a preview into the not-so-demure direction of modern Asian artists.

Both shows will run through April 14, 2013. Visit the Asia Society Texas Center Tuesday through Sunday from 11 a.m. to 6 p.m. (closed Mondays and all major holidays). Admission to the building is free, with a $5 exhibition entry fee for all non-members.

Stocks open higher on housing data, but 'cliff' looms

Stocks opened higher Wednesday as investors returned from the Christmas holiday, following a better-than-expected Case-Shiller home price index and as President Obama cut short his vacation in Hawaii to deal with the "fiscal cliff" negotiations.

The Dow Jones Industrial Average opened in positive territory, led by Caterpillar.?

The S&P 500 and the Nasdaq also gained at the open. The CBOE Volatility Index (VIX), widely considered the best gauge of fear in the market, traded near 18.

The S&P/Case Shiller home price index of 20 major cities rose 0.7 percent in October on a seasonally adjusted basis, topping expectations for a gain of 0.5 percent. And prices in the 20 cities jumped 4.3 percent from last year, beating forecasts for an increase of 4.0 percent.?

Obama will return to Washington early on Thursday, according to the White House, to deal with the deadlocked talks between Democrats and Republicans on what to do with $600 billion in tax increases and automatic spending cuts, due to kick in on Jan. 1.

Wall Street has been increasingly worried that the two sides may not reach a deal in time. Art Cashin, director of floor operations for UBS, said such an outcome would result in a 95 percent chance of a U.S. recession next year.

The worries over the fiscal cliff and an extremely weak report on the holiday shopping season could put retail stocks under pressure.?

Sales in the two months before Christmas rose just 0.7 compared to last year, the slowest rate of growth since 2008, according to the MasterCard Advisors Spending Pulse. Analysts had been expecting growth of 3 to 4 percent.

Amazon.com and Netflix were both slightly lower after an outage at an Amazon web service center impacted Netflix subscribers in the U.S., Canada, and Latin America on Christmas eve. Service was fully restored by Christmas day.?

Stocks in Europe were closed for the Boxing Day holiday. In Asia, markets closed higher on thin volumes, with Japanese stocks rallying to hit nine-month highs on a weaker yen.

Over the fiscal cliff: How hard a landing?

WASHINGTON (AP) ? Efforts to save the nation from going over a year-end "fiscal cliff" were in disarray as lawmakers fled the Capitol for their Christmas break. "God only knows" how a deal can be reached now, House Speaker John Boehner declared.

President Barack Obama, on his way out of town himself, insisted a bargain could still be struck before Dec. 31. "Call me a hopeless optimist," he said.

A look at why it's so hard for Republicans and Democrats to compromise on urgent matters of taxes and spending, and what happens if they fail to meet their deadline:

NEW YEAR'S HEADACHE

Partly by fate, partly by design, some scary fiscal forces come together at the start of 2013 unless Congress and Obama act to stop them. They include:

? Some $536 billion in tax increases, touching nearly all Americans, because various federal tax cuts and breaks expire at year's end.

? About $110 billion in spending cuts divided equally between the military and most other federal departments. That's about 8 percent of their annual budgets, 9 percent for the Pentagon.

Hitting the national economy with that double whammy of tax increases and spending cuts is what's called going over the "fiscal cliff." If allowed to unfold over 2013, it would lead to recession, a big jump in unemployment and financial market turmoil, economists predict.

WHAT IF THEY MISS THE DEADLINE?

If New Year's Day arrives without a deal, the nation shouldn't plunge onto the shoals of recession immediately. There still might be time to engineer a soft landing.

So long as lawmakers and the president appear to be working toward agreement, the tax hikes and spending cuts could mostly be held at bay for a few weeks. Then they could be repealed retroactively once a deal was reached.

The big wild card is the stock market and the nation's financial confidence: Would traders start to panic if Washington appeared unable to reach accord? Would worried consumers and businesses sharply reduce their spending? In what could be a preview, stock prices around the world dropped Friday after House Republican leaders' plan for addressing the fiscal cliff collapsed.

Federal Reserve Chairman Ben Bernanke has warned lawmakers that the economy is already suffering from the uncertainty and they shouldn't risk making it worse by blowing past their deadline.

WHAT IF THEY NEVER AGREE?

If negotiations between Obama and Congress collapse completely, 2013 looks like a rocky year.

Taxes would jump $2,400 on average for families with incomes of $50,000 to $75,000, according to a study by the non-partisan Tax Policy Center. Because consumers would get less of their paychecks to spend, businesses and jobs would suffer.

At the same time, Americans would feel cuts in government services; some federal workers would be furloughed or laid off, and companies would lose government business. The nation would lose up to 3.4 million jobs, the Congressional Budget Office predicts.

"The consequences of that would be felt by everybody," Bernanke says.

THE TAXES

Much of the disagreement surrounds the George W. Bush-era income tax cuts, and whether those rates should be allowed to rise for the nation's wealthiest taxpayers. Both political parties say they want to protect the middle-class from tax increases.

Several tax breaks begun in 2009 to stimulate the economy by aiding low- and middle-income families are also set to expire Jan. 1. The alternative minimum tax would expand to catch 28 million more taxpayers, with an average increase of $3,700 a year. Taxes on investments would rise, too. More deaths would be covered by the federal estate tax, and the rate climbs from 35 percent to 55 percent. Some corporate tax breaks would end.

The temporary Social Security payroll tax cut also is due to expire. That tax break for most Americans seems likely to end even if a fiscal cliff deal is reached, now that Obama has backed down from his call to prolong it as an economic stimulus.

THE SPENDING

If the nation goes over the fiscal cliff, budget cuts of 8 percent or 9 percent would hit most of the federal government, touching all sorts of things from agriculture to law enforcement and the military to weather forecasting. A few areas, such as Social Security benefits, Veterans Affairs and some programs for the poor, are exempt.

THERE'S MORE AT STAKE

All sorts of stuff could get wrapped up in the fiscal cliff deal-making. A sampling:

? Some 2 million jobless Americans may lose their federal unemployment aid. Obama wants to continue the benefits extension as part of the deal; Republicans say it's too costly.

? Social Security recipients might see their checks grow more slowly. As part of a possible deal, Obama and Republican leaders want to change the way cost-of-living adjustments are calculated, which would mean smaller checks over the years for retirees who get Social Security, veterans' benefits or government pensions.

? The price of milk could double. If Congress doesn't provide a fix for expiring dairy price supports before Jan. 1, milk-drinking families could feel the pinch. One scenario is to attach a farm bill extension to the fiscal cliff legislation ? if a compromise is reached in time.

? Millions of taxpayers who want to file their 2012 returns before mid-March will be held up while they wait to see if Congress comes through with a deal to stop the alternative minimum tax from hitting more people.

CALL THE WHOLE THING OFF?

In theory, Congress and Obama could just say no to the fiscal cliff, by extending all the tax cuts and overturning the automatic spending reductions in current law. But both Republicans and Democrats agree it's time to take steps to put the nation on a path away from a future of crippling debt.

Indeed, the automatic spending cuts set for January were created as a last-ditch effort to force Congress to deal with the debt problem.

If Washington bypassed the fiscal cliff, the next crisis would be just around the corner, in late February or early March, when the government reaches a $16.4 trillion ceiling on the amount of money it can borrow.

Boehner says Republicans won't go along with raising the limit on government borrowing unless the increase is matched by spending cuts to help attack the long-term debt problem. Failing to raise the debt ceiling could lead to a first-ever U.S. default that would roil the financial markets and shake worldwide confidence in the United States.

To avoid that scenario, Obama and Boehner are trying to wrap a debt limit agreement into the fiscal cliff negotiations.

SO WHAT'S THE HOLDUP?

They're at loggerheads over some big questions.

Obama says any deal must include higher taxes for the wealthiest Americans. Many House Republicans oppose raising anyone's tax rates. Boehner tried to get the House to vote for higher taxes only on incomes above $1 million but dropped the effort when it became clear he didn't have the votes.

Republicans also insist on deeper spending cuts than Democrats want to make. And they want to bring the nation's long-term debt under control by significantly curtailing the growth of Medicare, Medicaid and Social Security ? changes that many Democrats oppose.

Obama, meanwhile, wants more temporary economic "stimulus" spending to help speed up a sluggish recovery. Republicans say the nation can't afford it.

IT'S NOT JUST WASHINGTON

Seems like they could just make nice, shake hands and split their differences, right?

But there's a reason neither side wants to give ground. The two parties represent a divided and inconsistent America. True, Obama just won re-election. But voters also chose a Republican majority in the House.

Republican and Democrats alike say they are doing what the voters back home want.

Neither side has a clear advantage in public opinion. In an Associated Press-GfK poll, 43 percent said they trust the Democrats more to manage the federal budget deficit and 40 percent preferred the Republicans. There's a similar split on who's more trusted with taxes.

About half of Americans support higher taxes for the wealthy, the poll says, and about 10 percent want tax increases all around. Still, almost half say cutting government services, not raising taxes, should be the main focus of lawmakers as they try to balance the budget.

When asked about specific budget cuts being discussed in Washington, few Americans express support for them.

THE COUNTDOWN

Time for deal-making is short, thanks to the holiday and congressional calendars. Some key dates for averting the fiscal cliff:

? Lawmakers aren't expected to return to the Capitol until after Christmas, leaving less than a week to vote on a compromise before year's end.

? Obama and his family also left town for a Christmas vacation in Hawaii. The president said because the fiscal cliff was still unresolved, he would return to Washington this week.

? If lawmakers reach Dec. 31 without a deal, some economists worry that the financial markets might swoon.

? The current Congress is in session only through noon Eastern time on Jan. 3. After that, a newly elected Congress with 13 new senators and 82 new House members would inherit the problem.

Physiotherapy is similarly affected by this suspension of reality

When we prescribe exercise we apply stress to the body. ?We give only sufficient stress to stimulate a strong compensatory response to build more robust structures. ?This response takes from two to four days of relative rest to be complete.?

We therefore have the rule of consistently cycling between exercise and recovery: Basically one day of exercise, followed by two days of rest, then one more day of exercise etc.

If we break this rule and exercise hard daily, our risk of illness and injury skyrockets. ?All serious athletes know this. ?Apparently, many physiotherapists have never learned this, or have long forgotten.

With physiotherapy, it is common to have injured people instructed to perform sometimes strenuous exercise on a daily basis. ?This is wrong. ?A set of exercises are best performed every second or third day. ?If one is to exercise in between, then it should be an exercise that stresses the body in a different way. ?So if one lifts weights today, they should go for a walk or swim the following day - not lift more weights.

The only exceptions to this rule are activities like cycling, rowing, walking and swimming. ?Lifting weights, stretching cords and running require at least one rest day between sessions.

Re: Data Structure for Place Names - Family Tree Maker software ...

First, FMT hasn't changed its "structure" for place name; rather it changed its structure for resolving place names. Place names can now be resolved with an address, or a cemetery or church, or village or hamlet - in the far left part of the name.

In turn, FTM did something which is bewildering to a lot of us: it then added a heirarchy feature; which means you can see a listing of states, then counties within a state, cities with a county, etc. This is bewildering to a lot of us because we wonder why ALL place names couldn't be placed in a heirarchical view. After all, the heirarchical view is nothing more than reading a location name from right to left, instead of left to right.

That said, these are the reasons for putting a cemetery, church name, local name in a city (any large city), village name, hamlet name (espeially New York):

1) You can see all the people that lived in that particular place in the Place Workspace, seleting the place name and look at the panel on the right side of the screen.

2) Maintain separate GPS of locations. Now that GPS devices can find a location to within 10 feet, or even closer - it is (or will be) necessary to have a specific GPS set of coordinates for either the front gate of a cemetery, or even a grave within the cemetery; specific GPS for a specific address of a house, etc. Not all of us are up to speed in this technology (I know I'm not), but the future is coming at us!

Gunman kills woman at Pa. church, 2 men elsewhere

HOLLIDAYSBURG, Pa. (AP) ? A man fatally shot a woman decorating for a children's Christmas party at a tiny church hall and killed two men elsewhere in a rural township on Friday before he was shot dead in a gunfight with state troopers.

Three troopers in patrol cars were injured in a pursuit that began after the gunman, driving a pick-up truck, fired at them, police said. One trooper injured a wrist and then was hit in the chest but was saved by a bulletproof vest.

The gunman was killed during a final exchange of gunfire after ramming his truck head-on into another police cruiser, authorities said.

The shootings began in Frankstown Township, in central Pennsylvania, at about 9 a.m., and investigators were processing five crime scenes within about a 1.5-mile radius, authorities said at a news briefing Friday afternoon. Troopers were responding to a 911 call of a shooting in the township when they heard calls reporting at least one other shooting elsewhere, state police said.

"It's going to take us some time to put this all together ... and know exactly what occurred," said Lt. Col. George Bivens, deputy state police commissioner.

Authorities did not release the names of the victims or the shooter, though they did say the man lived in Blair County.

State police said they were still trying to piece together a timeline and motive. The gunman and the victims weren't related, though the victims may have been, at least distantly, Blair County District Attorney Rich Consiglio said.

Besides the woman, Bivens said, one man was shot at a residence, and the other man was shot at a crash site where the gunman "used his truck and also struck that vehicle much in the same manner that he did to our state police officer."

But family members of the victims said they were told the woman at the church was the first victim shot, the Pittsburgh Tribune-Review reported. The gunman then shot two men in the driveway of a home after a confrontation at a stop sign, one of the men's cousins, Marie Brenneman, told the newspaper.

"This person went to their driveway with a pistol, pointed at them and started shooting," Brenneman said.

She said both men were the shooter's neighbors in the tiny village of Geeseytown, about 70 miles west of Harrisburg, the state capital.

"They were uneasy around him," she said.

The woman at Juniata Valley Gospel Church had cooked food the day before for the funeral of the church's longtime pastor, said the Rev. James McCaulley, his brother. The church was still reeling from the Rev. David McCaulley's death when the woman returned to decorate its hall ? named after the pastor of 58 years ? and bullets ripped through a window, he said.

The gunman then entered and shot one of two women before he left, the reverend said.

Police identified the five crime scenes as the church; a home and ground around the home; a crash site where another victim was killed; the point in the road where the gunman opened fire on the troopers; and where the final encounter occurred after the truck collided with the police cruiser.

Bivens said investigators don't know if the victims were picked at random.

Besides the trooper wounded twice, a second trooper was injured by glass fragments in his eye and bullet fragments that hit him in the forehead, Bivens said. The third trooper suffered minor injuries from the head-on crash, he said.

"I think we have three very fortunate state police members tonight," Bivens said. "We are very thankful for the fact that they survived this attack. Someone was watching over them."

McCaulley, who is the pastor of another church about 50 miles away from the site of Friday's carnage, said his older brother began leading the Frankstown church in 1954.

"He preached his last sermon at the church in October before he fell ill," McCaulley said.

The church, which lists about 150 members in an online want ad posted this month for an associate pastor, is close-knit, and the woman killed Friday was among its more active members, McCaulley said. She had made food for him to take home Thursday since his wife had died this year, he said.

"The only thing I can say good at this time is that (the gunman) didn't do this 24 hours earlier when there was a big crowd in the church hall," McCaulley said. "We're devastated."

Friday's shootings were the second involving a rural Pennsylvania church this month.

An elementary school teacher is jailed on charges he fatally shot his ex-wife, a church organist, during a service in Coudersport on Dec. 2. The pastor and church members subdued him until police arrived.

In 2011, David Cameron issued the Hargreaves report, which set out to review the country's copyright laws and determine whether any reforms may be required, with a view to promoting economic growth.

The report established that laws in the UK were dated and that with a view to modern paradigms; copying of music, movies and other media for personal use should be legalised to place a stop to a negative consumer image and to prevent the stifling of some innovations.

The report?further?goes on to to establish new approaches to obtaining the right to use works with no clear author, removing legal ambiguity, along with new systems to protect parodied works, with a view to trends on services such as YouTube. ?By allowing more content that hasn't been shown to damage original IP to be used legally, the hopes are that this will provide a boost to the economy.

Of course, this isn't the first report to have suggested many of these approaches, with a 2006 report largely ignored, however Vince Cable now intends to implement most of the?Hargreaves?report's recommendations, announcing that the move was?"not only common sense but good business sense" and that?"bringing the law into line with ordinary people's reasonable expectations will boost respect for copyright, on which our creative industries rely."

Laws for legal backups have existed in Europe for quite some time, though with some countries issuing a levy on items such as laptops and CD players that are capable of copying media. Naturally enough, many of the bodies representing record and movie labels in the UK shouted out to receive similar treatment, however Mr Cable's report had this to say,?"Levies or other compensation are neither required nor desirable in the context of a narrow provision that causes minimal harm ... Levies are an unnecessary and inefficient tax on consumers. Furthermore, particularly in the current economic climate, it is not right to extract more money from the pockets of hard pressed consumers."

Release of full details of the proposal and its hopeful legalisation are expected to take place early next year.

WASHINGTON (AP) ? Despite all the hot fiscal cliff rhetoric, the differences between President Barack Obama and House Speaker John Boehner seem relatively narrow. So why haven't they shaken hands already? One answer: Both sides need to keep ? or get ? their own troops behind them.

In their cliff standoff, Obama wants to raise taxes by about $20 billion a year more than Boehner. The two men differ over spending cuts by roughly the same amount.

That's real money by most measures. Yet such numbers are barely noticeable compared to the $2.6 trillion the government is projected to collect next year, and to the $3.6 trillion it's expected to spend.

As the "cliff" approaches ? economy-shaking tax increases and spending cuts that start hitting in early January unless lawmakers act first ? each side says the other isn't being serious enough about trimming federal deficits. But their inability so far to strike a compromise underscores that their problem is more than arithmetic ? it's also about the difficult politics that Democrat Obama and Republican Boehner face when it comes to lining up votes.

Chastened by Obama's re-election, Boehner has violated a quarter-century of Republican dogma by offering to raise taxes, including boosting income tax rates on earnings exceeding $1 million annually. Eager for a budget deal that would let him move on to other issues, Obama in turn would cut the growth of Social Security benefits, usually off-limits to Democrats. He also would impose tax increases on a broader swath of people than millionaires ? those with incomes over $400,000. But that figure, too, is a retreat from what he campaigned on: the $200,000 income ceiling on individuals and $250,000 on couples.

That means both men have angered lawmakers and staunch supporters of their respective parties, just when the need to retain that support is crucial. Neither wants to risk his political capital by embracing a deal his own party rejects.

"When you walk into a room and represent a group and you have to give ground to get a deal, you have to stay in that room as long as you can and you have to walk out with blood on your brow," said Joseph Minarik, research director for the Committee for Economic Development and a veteran of grueling budget talks as a former Clinton White House and House Democratic aide. "Otherwise, the people outside the room don't believe you've fought hard for them."

With no quick resolution in sight, Boehner worked Thursday to push a backup bill through the House that would raise taxes on people earning at least $1 million but not on those making less. A separate bill would replace across-the-board cuts in defense and domestic programs with cuts in Obama's health care overhaul and other specified programs.

Economists say the tens of billions of dollars separating the president and speaker are relatively minuscule, especially when compared to the size of the U.S. economy, which exceeds $15 trillion a year.

"It's not vanishingly small, but it is minor," said Alan D. Viard, a tax scholar at the conservative American Enterprise Institute. "It certainly would be a disappointment if that minor of a gap would end up blocking an agreement."

Even though Obama's and Boehner's dollar differences are small, one hindrance to a deal could be the symbolic political consequence of retreating on their numbers, even just by a little.

For Boehner to add, say, another $100 billion to the tax increase over 10 years could well mean that people with incomes well below $1 million a year would get a tax increase, something he wants to limit.

On the other hand, adding $100 billion more in spending cuts could mean a deeper hit than Obama wants to Medicare. The president prefers to limit Medicare cuts to the reimbursements that doctors and other health care providers receive, but ever deeper cuts could mean more doctors would be likely to stop treating Medicare patients ? an outcome Democrats don't want.

None of this means there aren't real budget differences between Democrats and Republicans.

Obama has proposed raising taxes by $1.2 trillion over the coming decade by boosting the current top 35 percent rate to 39.6 percent for income over $400,000, plus other increases on the highest earning Americans. He's also says he's offered about $1.2 trillion in spending cuts over 10 years, including slowing the growth of benefits from Social Security and other programs.

In addition, the president would pluck $400 billion in savings from Medicare and Medicaid, the health care programs for the elderly and poor whose defense Democrats consider precious priorities.

Boehner has offered about $1 trillion in tax increases and roughly the same amount in spending savings. An earlier Boehner offer included $600 billion in Medicare and Medicaid savings ? well more than Obama ? but it's unclear whether the speaker is still seeking that figure.

Because of a dispute over how some savings are classified, Boehner says Obama's offer is really $1.3 trillion in higher taxes and only about $850 billion in spending cuts.

The House speaker says Obama's offer is not balanced because its new taxes and spending cuts are unequal. And he complains it does too little to control fast-growing benefit programs like Medicare, a chief driver of the federal government's mushrooming deficits.

"The real issue here, as we all know, is spending," Boehner said Thursday. "You go through all these discussions, I don't think the White House has gotten serious about the big spending problem the country faces."

The two men's differences work out to $200 billion over 10 years in taxes, and about the same in spending, depending on whose numbers are used. Either way, their gap is less than 1 percent of the money the government will spend and tax anyway.

"They're a couple hundred billion apart. This is absolutely senseless," said Senate Majority Leader Harry Reid, D-Nev., insisting Boehner should compromise. "These are gyrations I've never seen before."

There are other differences, too.

Obama wants several billion dollars in infrastructure spending to goose the economy and to extend expiring unemployment benefits. He also wants the government's authority to borrow money extended for two more years ? until after the 2014 congressional elections ? with Congress having little more than symbolic opportunities to block it, a year longer than Boehner has offered.

Even so, the numbers being proposed by Obama and Boehner are so close, and the political risks both men have taken on taxes and Social Security benefits are so stark, that many consider it almost unthinkable that they would not eventually complete a deal.

"Having come out of their trenches, they either have to shake hands or get shot, maybe by their own troops," said Robert Bixby, executive director of the nonpartisan Concord Coalition, an anti-deficit group.

"Chance' is so affectionate! He came right up to me and nudged my hands right out of my lap so I would pet him, and when I did, he just melted into my lap! He has completely won my heart! Also, I have never seen a coat quite the color of Chance's - it's a gorgeous, chocolate mixed with some brindle. Chance is very mellow and friendly, and he loves other dogs and all people. He is about 3 months old!
